Terms and Conditions

We are Kappa Tour LLC References to "We", "us" and "our" in these booking conditions means Kappa Tour LLC References to "you" and "your" in these booking conditions means all persons on the booking (including anyone added or substituted at a later date).

These booking conditions along with any other written information we brought to your attention before we confirmed your booking, form the basis of your contract with us for the travel arrangements detailed on www.kappatour.com and making up your booking (‘your arrangements’). Please read them carefully as they set out our respective rights and obligations. By making a booking, you agree on behalf of yourself and those you represent to be bound by all of them. If you are booking for another person you agree to inform that person(s) about the Terms & Conditions that apply to the travel reservations and bookings you have made on their behalf, including all rules and restrictions applicable.

You must be of legal age at the time of booking and possess the legal capacity and authority to act and travel as the lead name on the booking. We will only deal with the lead name on the booking in all correspondence.

Special Note: We endeavor to ensure the accuracy of all the information and prices on our website and in our advertising material. However, occasionally changes and errors do arise and we reserve the right to correct them in such circumstances. You must check the current price and all other information relating to the arrangements that you wish to book before your booking is confirmed.

In these terms, a ‘package’ means the pre-arranged combination of at least two of the following components when sold or offered for sale at an inclusive price and when the service covers a period of more than twenty-four hours or includes overnight accommodation: —(a) transport; (b) accommodation; (c) other tourist services not ancillary to transport or accommodation and accounting for a significant proportion of the package.

1. VALIDITY

These terms apply for reservations made from 7th January 2022 onwards.

Rescheduled bookings are subject to the Terms and Conditions that are valid at the time of the new booking confirmation i.e. if you rearrange your booking on 7th January onward the following T&C will apply.

 

2. OUR AGREEMENT

An online booking process must be followed in order to book your holiday. In some cases, where you contact our Customer Service team, we will complete this process on your behalf. By submitting (or agreeing that we may submit on your behalf) the booking via our website, you accept these terms on behalf of all persons named on the booking. A binding agreement for your arrangements will come into existence between you and us when we issue a confirmation. Please check all your booking details, including your personal information, before submitting your booking for confirmation. If you are booking through our Customer Service team, please ensure that you provide all the correct information, and check the confirmation (or any other document issued) immediately on receipt. It may not be possible to make changes to your arrangements later so you should notify us of any inaccuracies in any documentation within the following 48 hours of our sending it out, using the “Contact Us” form on our website. You can also access your booking details in your “My Account”.

The suppliers delivering the services in your arrangements work in accordance with their own terms and conditions which will also form part of your agreement with us. Some of these terms and conditions may limit or exclude the supplier's liability to you, usually in accordance with applicable International Conventions.

Travel is personal and each individual’s goals and experiences may differ. We will not be bound by, or liable for, any description, photograph, representation or warranty made by or provided by any independent third party sales representative, travel agent, or other person or entity relating to any holiday/vacation offered by Kappa Tour.

3. PAYMENT

You must make payment for your arrangements in accordance with the instructions we give you. Generally speaking, in order to reserve your place, a deposit must be paid at the time of booking. The full balance must also be received before 60 days to your intended departure date. Bookings made 60 days or less before departure must be paid for in full at the time of booking. If we do not receive any payment due in full and on time, we reserve the right to treat your booking as cancelled by you in which case the cancellation fees set out in the section “Cancellations by the Customer” will apply.

4. INSURANCE

We recommend that all persons on the booking purchase comprehensive travel insurance. Certain countries have a requirement for foreign visitors to have valid medical insurance on entry. We cannot be held responsible for denied entry if a guest is unable to provide details to authorities of insurance or denial of entry for any reason. Please note that insurance companies usually limit the time between booking and/or departure date and the issuance of the policy and therefore we recommend purchasing the insurance immediately after receiving the confirmation of the booking from us.

5. SPECIAL REQUEST

Special requests relating to your arrangements must be advised to us at the time of booking and confirmed to us in writing. While we will try to meet or arrange your reasonable special requests, we cannot guarantee that they will be fulfilled. Special requests that have been noted on your confirmation or any other documentation do not amount to a promise to meet that request. A failure to meet any special request will not be a breach of contract on our part unless the request has been specifically confirmed.

6. DISABILITIES AND MEDICAL PROBLEMS

If you or any member of your party has any medical problem or disability which may affect your chosen arrangements, please provide us with full details before we confirm your booking so that we can try to advise you as to their suitability for you. Acting reasonably, if we are unable to properly accommodate your needs, we will not confirm your booking or if you did not give us full details at the time of booking, we will treat it as cancelled by you when we become aware of these details.

7. THE PRICE YOU PAY

The price of your chosen arrangements is calculated based on the services and dates you select, and will depend on the number of persons included in the booking. It is your responsibility to review the sections of your enquiry titled "the price includes" and "price does not include" before completing the booking process.

In some countries, hotels or other travel services may require payment of a fee or tourist tax locally. Please enquire us for further details.

Please note that we reserve the right to amend the price of unsold holiday arrangements at any time and correct errors in the prices of confirmed holidays.

8. CANCELLATION POLICY

8.1 Cancellation by the Customer

Once a partial or full payment has been made, cancellations will be only accepted in writing. If you wish to cancel you must inform us using the “Contact Us” form on this website as soon as possible.

Your notice requesting a cancellation will only take effect when it is received in writing, and if it is received outside our Customer Service operating hours, it will only be effective from the next working day (see our Customer Service operating hours in the section “Contact” of this website). If there are specific cancellation conditions for particular arrangements, these will be referred to in the paragraph headed "conditions" in your enquiry. If no such specific conditions are detailed, cancellation charges set out below.

Free Cancellation with Premier Protection Plan

The COVID-19 pandemic has not only created an unparalleled impact on health and economy globally, but it has also changed fundamental behaviors with regards to travelling. In response to such changes, Kappa Tour is applying exceptional measures that will facilitate the recovery of the travel, especially for customers that are willing to travel despite the uncertainty.

You can request a cancellation anytime and for any reason 60 days before your departure. In this case, 100% of the price paid for your trip except premier protection plan fee will be returned to you in Kappa Tour credit and no penalties or cancellation fees will be applied.

Once the cancellation is informed by you, the travel credit will be activated in your “My Account” under the section “Kappa Tour Wallet” immediately. Our Customer Service will notify you as soon as the transaction has been completed.

The Kappa Tour credit is a non-refundable virtual wallet that can be used towards any of the trips on this website at any time (the travel credit will not expire). If the value of your next booking is lower than your outstanding credit balance, the remaining amount will remain available in your wallet, ready for any additional reservation. On the contrary, if the value of your next booking is higher than your outstanding balance, the remaining amount will be paid by you following the payment terms defined in the section ‘2. Payments.’

Should you wish to decline the use of the Kappa Tour credit as the means of reimbursement, you can opt for a cash reimbursement which will include the application of the following conditions: 20% of the total holiday cost to be deducted as penalty plus premier protection plan fee of 50 USD plus 150 USD as cancellation fee per passenger.

Protection in case of COVID-19 infection by the passengers with Premier Protection Plan

Additionally, to the previously defined “free cancellation policy”, your booking will be protected in case you test positive of COVID-19. In this case, we shall return 100% of the price paid for your trip except premier protection plan fee will be transferred in travel credit in your account and no penalties or cancellation fees will be applied. For any reason when a date change or cancellation request is made by you, the premier protection plan fee of 50 USD is non-refundable.

The following conditions will apply:

  • The infection must occur to you or the passengers confirmed in your booking.
  • A certificate must be delivered by a physician with the proof of a positive test issued by an officially recognized medical organization. The supporting documentation must be sent to our Customer Service team before the departure date using the “Contact Us” form on our website.
  • The infection must be produced within the 7 days before departure.

The Kappa Tour credit is a non-refundable virtual wallet that can be used towards any of the trips on this website at any time (the travel credit will not expire). If the value of your next booking is lower than your outstanding credit balance, the remaining amount will remain available in your wallet, ready for any additional reservation. On the contrary, if the value of your next booking is higher than your outstanding balance, the remaining amount will be paid by you following the payment terms defined in the section ‘2. Payments.’

Should you wish to decline the use of the Kappa Tour credit as the means of reimbursement, you can opt for a cash reimbursement which will include the application of the following conditions: 75% of the total holiday cost to be deducted as penalty plus premier protection plan fee of 50 USD plus 150 USD as cancellation fee per passenger.

Other Cancellation by you

For cancellations requested after 60 days (once the Free Cancellation term have expired), since we incur costs in cancelling your travel arrangements, such as for the flights which are non-refundable in all cases, penalties and cancellation fees shall apply to packages and/or services based on the anticipation of the contract termination, as indicated below. For any reason when a date change or cancellation request is made by you, the premier protection plan fee of 50 USD is non-refundable.

Period before departure in which you notify us:

  • 60 to 21 days prior to departure, 50% of the total holiday cost will be deducted as penalty plus premier protection plan fee of 50 USD plus 150 USD cancellation fee per passenger will be applied.
  • Less than 21 days prior to departure, 75% of the total holiday cost will be deducted as penalty plus premier protection plan fee of 50 USD plus 150 USD cancellation fee per passenger will be applied.

If the reason for your cancellation is covered under the terms of your insurance policy, you may be able to reclaim these charges.

We will deduct the cancellation charge(s) from any monies you have already paid to us. If you are entitled to a refund, this will be issued within 14 days of the date you inform Kappa Tour of the cancellation.

8.2 Cancellation by Kappa Tour

COVID-19 protection in case of travel ban

The COVID-19 pandemic has not only created an unparalleled impact on health and economy globally, but it has also changed fundamental behaviors with regards to travelling. In response to such changes, Kappa Tour is applying exceptional measures that will facilitate the recovery of travel, especially for customers that are willing to travel despite the uncertainty.

If you can’t travel due to any of the following cases, you will be able to make a free reschedule (no fees or penalties applied):

  • Borders closed to visitors - there is an official travel ban from the destination country, where a government resolution has been issued forbidding the entry of foreign visitors.
  • Government restrictions in origin - there is an official travel restriction from the country of origin where a government resolution has been issued forbidding the travel to the relevant destination.
  • Mandatory quarantine at destination - there is an official mandate to go on quarantine at the relevant destination and it cannot be avoided by any alternative measure (negative COVID-19 test, for instance).
  • Airline not operative - the relevant airline is not operating the scheduled flight as a consequence of a COVID-19 lockdown.
     

When rescheduling, you must pay any extra costs or charges incurred or imposed by any of our suppliers (for instance, the increase of the flight price due to changing of the date).

If we are unable to offer you a reschedule, we shall migrate the funds paid for your cancelled trip to Kappa Tour credit. The travel credit will be activated in your “My Account” under the section “Kappa Tour Wallet” inmeditately. Our Customer Service will notify you as soon as the transaction has been completed.

The Kappa Tour credit is a non-refundable virtual wallet that can be used towards any of the trips on this website at any time (the travel credit will not expire). If the value of your next booking is lower than your outstanding credit balance, the remaining amount will remain available in your wallet, ready for any additional reservation. On the contrary, if the value of your next booking is higher than your outstanding balance, the remaining amount will be paid by you following the payment terms defined in the section ‘2. Payments.’

Should you wish to decline the use of the Kappa Tour credit, you can opt for a reimbursement of the funds on the same method of payment used when making the booking by contacting our Customer Service team.

Other Cancellation by Kappa Tour

Except where otherwise expressly stated in these booking conditions we will not be liable or pay you compensation if our contractual obligations to you are affected by Force Majeure i.e. any event which we or the supplier(s) of the service(s) in question could not, even with all due care, foresee or avoid. These events can include, but are not limited to war, threat of war, civil strife terrorist activity and its consequences or the threat of such activity, riot, the act of any government or other national or local authority including port or river authorities, industrial dispute, lock closure, natural or nuclear disaster, fire, chemical or biological disaster and adverse weather, sea, ice and river conditions and all similar events outside our or the supplier(s) concern’s control.

We consider a pandemic like COVID-19 a force majeure event. However, due to the fact that COVID-19 has been of an unparalleled impact for the travel industry, both businesses and travellers, Kappa Tour has defined a series of special conditions to facilitate the recovery of our activity. These special conditions have been described in detail in the previous section.

For group travels, Kappa Tour designs specific arrangements in destination considering a certain quantity of passengers therefore in some cases if the minimum number is not reached, we reserve the right to cancel your booking and addresses as a “major change” with the conditions mentioned in the chapter 8. Changes below.

9. CHANGES

9.1 Changes by the Customer

If you wish to make any changes to your arrangements after they have been confirmed, you must inform us in writing using the “Contact Us” form on this website as soon as possible.

Your notice requesting a change will only take effect when it is received in writing, and if it is received outside our Customer Service operating hours, it will only be effective from the next working day (see our Customer Service operating hours in the section “Contact” of this website). In the event that we are unable to assist with making a requested change, and you do not wish to proceed with the original booking we will treat this as a cancellation by you and the conditions mentioned in the section ‘7.1 Free Cancellation by you’ or ‘7.2 Other Cancellation by you’ will apply based on the anticipation to the departure date.

We can’t guarantee that changes can be met, although we will do our best to assist. In the event we can meet your requested change, you shall pay any applicable rate changes or extra costs incurred by KAPPA TOUR and any costs or charges incurred or imposed by any of our suppliers.

Certain arrangements, in particular sums paid for flights, may not be amended after they have been confirmed and any alteration or cancellation could incur a charge of up to 100% of that part of the arrangements in addition to the charges above.

9.2 Changes by Kappa Tour

Pre-departure changes

Because we plan your arrangements many months in advance, in some circumstances we must reserve the right to make changes to them and cancel them.

Most changes will be minor, and while we will do our best to notify them to you as soon as reasonably possible before your departure, we will have no other liability to you in respect of them.

Examples of “minor changes” made before departure include the following:

  • A change of overall length of your arrangements of twelve hours or less.
  • A change of accommodation to another of the same standard or classification.

Occasionally we may have to make a major change to your confirmed arrangements. Examples of “major changes” made before departure include the following:

  • A change of accommodation area for the whole or a significant part of your time away.
  • A change of accommodation to that of a lower standard or classification for the whole or a significant part of your time away.
  • A change of overall length of your arrangements of twelve hours or more.
  • A significant change to your itinerary, missing out one or more destinations entirely.
  • The entire cancellation of the trip due to the unreaching of the minimum quota for the group (this only applies for group travelling).

If we have to make a major change or cancel, we will tell you as soon as possible and if there is time to do so before departure, we will offer you the choice of:

  • Accepting the changed arrangements
  • Having a refund of all monies paid
  • Accepting an offer of alternative arrangements of comparable standard from us, if available (we will refund any price difference if the alternative is of a lower value, the same way you will incur in extra costs if the alternative is of a higher value).

You must notify us of your choice within 3 days of our offer. If you fail to do so we will assume that you have chosen to accept the change or alternative arrangements.

We will not pay you compensation and the above options will not be available where:

  • We make a minor change
  • We cancel as a result of your failure to make payment in accordance with these terms
  • Where the change(s) or cancellation by us arises out of alterations to the confirmed booking requested by you.

Post-departure changes

If we become unable to provide a significant proportion of your arrangements after you have departed, we will make alternative arrangements for you but if it is impossible to do so, or you choose not to accept them for good reasons, we will, where appropriate, provide you with equivalent transport back to your place of departure or another place we both agree. If your arrangements are a package, and if appropriate in all the circumstances, we will also pay you reasonable compensation with the exception of changes or cancellations are caused by "force majeure" (please see the forthcoming section for more details), we regret we will be unable to make any refunds, pay you compensation or meet any costs or expenses you incur as a result. The above sets out the maximum extent of our liability for changes and cancellations and we regret we cannot meet any other expenses or losses you may incur as a result of any change or cancellation.

10. SERVICES

10.1. What's included in the price?
A tour’s program price includes the following:
• Standard rooming occupancy (see Rooming section).
• The non-refundable reservation fee.
• Departure fees and surcharges.
• Round-trip airfare, unless the land-only package is selected.
• Airport transfers, unless the land-only package is selected or Special Travel Arrangements are made (see Flight Information and Special Travel Arrangements sections).
• Accommodations during tour as specified in the tour itinerary.
• A dedicated Tour Leader as specified in the tour itinerary.
• Panoramic city tours as specified in the tour itinerary.
• Breakfast as specified in the tour itinerary.
• Meals if included as specified by the tour itinerary.
• Transportation between cities and activities such as buses, cruises, ferries, trains or flights as specified in the tour itinerary.

• Premier protection plan fee of 50 USD. (If specified in the services included in the price)
 

What's not included in the program price?
A tour’s program price does not include the following:
• Rooming upgrades.
• Optional excursions.

• Alternative tours
• Tour extensions.
• Travel Protection.
• Beverages, lunch, and dinner (except where specified in the itinerary).
• Transportation to free-time activities.
• Customary gratuities (for your Tour Leader, bus drivers and local guides).
• Porterage.
• Any applicable baggage-handling fees imposed by the airlines (see Flight Information section).

•Accommodation taxes if charged by local authorities

• All personal expenses

• Any other services is not specified in the tour itinerary as included.
• Expenses caused by airline rescheduling, cancellations or delays caused by the airlines, bad weather or events beyond Kappa Tours’s control (see Flight Information section).
• Passport, visa, reciprocity fees or other fees associated with meeting destination entry requirements.

 

10.2. Flight information
We always do our best to provide the most direct route to your destination. In order to pass on the best overall value to our travelers, however, certain routings may not be available, and we cannot guarantee non-stop or direct flights. Kappa Tour cannot guarantee that you and your companions will travel on the same flights. Seat assignments are generated by the airline and will be provided upon check in. You are responsible for any baggage handling fees imposed by the airline. If a traveler is not satisfied with their flight reservation, KAPPA TOUR’s Standard Cancellation Policy (see Cancellations and Modifications section) will apply.
Once you are ticketed, you are responsible for any costs associated with changes including but not limited to: name correction, change in gateway, routing preferences or departure time requests. These changes could result in additional costs, most often ranging from $300 in airline fees up to the full cost required to purchase a new published fare airline ticket.
Yes, you must travel on all legs of your itinerary. If you do not travel on a portion of your flight itinerary, the remaining portions will be cancelled by the airline. If this happens, you will be responsible for purchasing a new ticket and any service fees charged by the airlines. If you miss a leg of your flight resulting in a delayed arrival, you will not be reimbursed for the missed portions of the trip.
Kappa Tour is not responsible for airline schedule changes, personnel strikes impacting service, flight cancellations, or airline delays due to weather, mechanical requirements, capacity, or any other reason. If your flight is delayed or cancelled, it is your responsibility to work directly with the airline to get re-booked on a new itinerary as needed. Once your new flight is confirmed, you must then notify Kappa Tour with your updated arrival time. If you are arriving later than your original scheduled flight, you may not be met by a Kappa Tour representative at the airport. If this is the case, you will be responsible for making your own transportation arrangements from the airport to the first accommodation on your itinerary.
Kappa Tour is not responsible for costs associated with a flight delay or cancellation, such as (but not limited to) hotels, meals, or additional airline charges. In the event an airline delay or cancellation causes you to miss time on tour, you will not be reimbursed for missed portions of the trip, including but not limited to accommodations, meals, excursions or sightseeing tours.
Flights to and from the following destinations may originate/end at any of the airports in that vicinity. On occasion, you may be booked on a flight itinerary returning to a different airport than the one you departed from. If you have selected one of the following interchangeable airports during your enrollment process and prefer a specific gateway of those listed below, you must communicate that preference to Kappa Tour in writing up until 99 days prior to departure. Please note that Kappa Tour cannot guarantee availability and additional costs may be associated to accommodate your preference, for which you are responsible. Your preference may also result in additional travel legs to your itinerary due to routing options available within our contracts with the airlines.
• New York: JFK, Newark or LaGuardia
• Washington, D.C./Baltimore: BWI, Dulles or Ronald Reagan National
• Miami: Miami or Fort Lauderdale
• Houston: George Bush Intercontinental or Hobby
Your flight itinerary and e-ticket number will be posted in your online account at efultimatebreak.com 30 days prior to the scheduled departure for your tour. Kappa Tour will provide your itinerary only after your account has been paid in full, and after you have agreed to these Booking Conditions and Release & Agreement.
While it is not recommended, you can elect to make your own flight arrangements. To do so choose the “land only” option (without flights). If you select this option, you are responsible for booking your own flights arriving in time for the scheduled start of your tour as published; please review the itinerary closely for when tour activities begin based on time zone differences and travel times to said destination from your domestic home gateway.
Please note that Kappa Tour handles all transportation during your tour, so any flights between cities mentioned on your itinerary are included as part of your tour package.
Transfers to and from the airport at your destination are included in the tour price for travelers who purchase flights from Kappa Tour. (If you plan to make a Special Travel Arrangement, please review the Special Travel Arrangement Terms & Conditions for additional details and requirements regarding eligibility for transfers.) If you book your flights independent of Kappa Tour, however, Kappa Tour will not arrange airport transfers and you are responsible for arranging your own transportation to the first accommodation listed on your itinerary and back to the airport at the end of tour.
If it is necessary for Kappa Tour to change or cancel your travel program in any way (see the Itinerary Modifications section), you are responsible for altering your flight plans accordingly and any costs that result from such changes or cancellations. To avoid these costs, Kappa Tour recommends that you should not book your own flights or other independent travel arrangements until your trip has been confirmed at 60 days prior to departure.

 

 

10.3. Luggage (Airlines)

Checked bags are typically limited to a total dimension of 62 inches by adding length + width + height (example: 26"+26"+10" = 62"), and a maximum weight of 50 lbs (23kg). Smart Bags with a USB charging port, GPS tracking device and other high-tech features are prohibited as checked or carry-on baggage unless the bag is made with removable batteries and the batteries are removed and stored separately. For specific requirements of your airline and for a complete list of fees, please visit www.kappatour.com. Many airlines apply charges for checked bags including flights which begin and end within the USA. Kappa Tour avoids the most inexpensive airfare options commonly known as Basic Economy airfares which typically do not include any checked bags nor seat assignments before the day of departure. However, for some airlines, other airfare categories also do not include checked baggage. This will be clearly displayed in our airfare selection and on your invoice. Where available, we highly recommend selecting airfares which include at least 1 piece of checked baggage. Checked baggage allowances displayed on reservation details and invoices reflect the applicable allowance at the time of booking but are subject to change by your airline(s). Kappa Tour is not responsible for checked bag fees, excess luggage or weight charges levied by an airline. Nor will Kappa Tour be responsible for luggage that is lost or damaged by the airline. If your luggage is lost or damaged by the airlines, a baggage claim form MUST be filed with the carrier before leaving the airport. We recommend that you use brightly colored luggage tags, straps or other identifiers to help you locate you luggage upon arrival or to describe it in the event that it is lost.

10.4. Luggage (Escorted Tours)

All Kappa Tour escorted tour buses allow one piece of luggage per person, plus carry-on bag. Additional baggage will be subject to a handling charge of $100 per piece. As Kappa Tour will not be responsible for loss or damage to luggage and personal belongings, you MUST report any loss or damage immediately at the time of the incident and obtain a written report from the local authority for submission to your insurance provider. Airline luggage allowances may differ and be subject to fees; for specific requirements and a complete list of fees, please visit www.kappatour.com.

 

10.5. Hotel Accommodations

All rooms are standard twin-bedded (two single beds) rooms with private facilities, unless you have specifically requested and paid for an upgraded room category. Room selection in all cases, unless otherwise reserved, is strictly at the discretion of the hotel's management on a run-of-house basis. Special requests such as bed types, smoking preference and connecting rooms are subject to availability. Triple rooms consist of standard twin beds or one double bed plus a sofa/folding bed or cot for third person except in the U.S. and Canada, where triple rooms often consist of two double/queen beds for three persons; a fee may be charged by the hotel for the addition of a cot/rollaway. Some single rooms are smaller than a standard room size. The number of persons accommodated does not dictate the room size. Although available at most 4 and 5 star hotels, use of air-conditioning abroad differs greatly from the United States. Many European and Canadian hotels were built before central air-conditioning was introduced. Air-conditioning is often shut down at night and from the end until the start of the summer months. All hotel rates are based on Kappa Tour Travel's agreements with its suppliers and are not negotiable. Hotel check-in time is generally not before 4:00 p.m. and check-out time is prior to noon. Please be sure that adequate arrangements for accommodations have been taken into consideration when a late night flight is being used. If a day room is included in the itinerary, check-out will normally be 6:00 p.m. We reserve the right to make substitutions with hotels of equal standard. There will be no refunds for any difference in the cost of those accommodations.

Hotel & Cruise Profiles

Kappa Tour Travel's hotel and cruise ship profiles are based upon information provided to Kappa Tour by hotel and cruise ship partners and their representatives, including images and descriptions of individual properties. Star-ratings may differ from country to country. Kappa Tour does its best to maintain current information, however is not responsible for any inaccuracies, changes in description details or amenities, or images provided by third parties.

 

Non-Operation of Escorted Tour

Escorted tour packages are based upon a minimum number of participants. Kappa Tour reserves the right to cancel or reschedule any escorted tour or individual booking for any reason including insufficient demand or events beyond our control. Cancellation will be advised at least 45 days prior to the tour's departure, and all money will be refunded. Kappa Tour will not be held responsible for any costs relating to the issuance and/or cancellation of airline tickets or visa fees. Voluntary cancellations due to political instability, acts of terrorism, government intervention or US State Department warning will be subject to the above fees, provided the program is deemed (by Kappa Tour) able to continue.

 

RIVER CRUISES

Cabin Assignment

Depending upon the vessel, cabin numbers may be assigned at the time of reservation. Assignments are subject to change. We also reserve the right to amend cabin assignments onboard without prior notification. Shore excursions which are not included in the cruise package may only be purchased aboard ship unless an optional tour package is available for advance purchase.

Inability to Sail

Neither Kappa Tour nor the owners or operators of the vessels shall be liable for delay or inability to sail or perform due to any condition caused by or arising from water level, inoperable locks, strikes, lockout, civil or labor issues, explosion, fire, collision, vessel breakdown or damage to the vessel, its hull, machinery or fittings. Neither shall they be responsible for issues caused by or arising from civil commotion, riot, insurrection, war, government restraint, requisitioning of the vessel, political disturbance, acts or threats of terrorism, epidemics or the threat thereof, inability to secure or failure of supplies including fuel, Acts of God, or other circumstances beyond their control. In such cases, part or all of the cruise itinerary may be operated by motor coach and accommodations provided by hotels. When the option exists, the operator will "swap ships" with another vessel sailing in the opposite direction. Crew, ship and cabin configuration may differ. If one of these options becomes necessary, Kappa Tour will endeavor to provide equal or similar services, however no tour will be canceled and no monetary compensation will be made for those changes.

 

10.6. Health Requirements

Check with your healthcare provider for up-to-date requirements. You may also check the Centers for Disease Control (www.cdc.gov) and/or the World Health Organization (http://www.who.int/en/) for their recommendations. Required inoculations, if any, must be recorded by clients' health practitioner on a valid vaccination certificate which the client must carry for proof of inoculation where required. Individuals with heart disease, chronic illness, physical handicap, advanced pregnancy, or mental illness should not participate in these rigorous travel programs. Any person who arrives to the destination ill with apparent fever or becomes ill during the tour, will be removed from the group and directed to a local medical facility for diagnosis. Only upon written clearance by an accredited medical facility that the guest is able to participate in the remaining activities of the tour will that individual be allowed to resume group travel. All costs associated with medical treatment and related expenses such as additional hotel nights or transportation not included in the original itinerary, will be the responsibility of the passenger. Travel protection plans will only consider coverage with documentation and receipts for services provided by legally qualified health-care facilities, and in accordance with policy terms.

Please note that some countries may require aircraft cabin insecticide treatment for in-bound foreign flights. A list of such countries is available at:

10.7. Weapons

Are not permitted on any tour including, but not limited to, firearms, knives, mace, brass knuckles, and other weapons of any type.

10.8. Special travel arrangements
If you would like to arrive early at your destination, stay behind to explore more, or visit another city, Kappa Tour can help you to customize your travel itinerary to fit your travel preferences. Requests to customize your itinerary are available for a non-refundable special travel fee of $75 plus any additional airline costs incurred. Please note that options are subject to airline availability and Kappa Tour cannot accommodate requests to arrive after the scheduled start of the tour or to depart before the scheduled end of the tour. Your Special Travel Arrangement is personal travel time, without the services of a Tour Director or the company of your tour group. Kappa Tour is unable to recommend or book accommodations, airport transfers, sights, or transportation between cities for you during your Special Travel Arrangement. You are responsible for making all these arrangements on your own and the associated costs. As noted in the previous section of this document, we do not advise booking your own flights or travel arrangements until your tour has been confirmed at 60 days prior to departure.
You can request a Special Travel Arrangement upon enrollment or until 99 days prior to departure through your online account. If Kappa Tour can confirm your request for a Special Travel Arrangement, your online account will reflect your new travel dates and gateways in addition to a $75 non-refundable special travel fee. Should your reservation incur additional costs with the airlines, an Kappa Tour Trip Consultant will contact you to discuss your options.


10.9. Special Travel Arrangement Terms & Conditions
Kappa Tour cannot guarantee that we will be able to accommodate your request for a Special Travel Arrangement. Options are subject to airline availability and additional airline costs, which are the responsibility of the traveler. If you request to fly into or out of a different international gateway, there are often costs incurred. If Kappa Tour is unable to accommodate your Special Travel Arrangement request, KAPPA TOUR’s Standard Cancellation Policy (see Cancellations and Modifications section) still applies.
Kappa Tour cannot guarantee specific airlines, routings, or flight time preferences. Kappa Tour also does not guarantee that you and your traveling companion(s) can be booked on the same flight itinerary. Additionally, please note that if you are traveling with a companion who has not made the exact same Special Travel Arrangement, you will most likely not be on the same flight itinerary due to your differing travel dates and/or destinations; this is to be expected even if you are traveling from the same domestic home gateway.
If you purchase the Travel Protection plan through Kappa Tour, the plan does not provide coverage during any Special Travel Arrangement days. See https://www.kappatour.com for official information from the insurance provider about period of coverage.
If you book a Special Travel Arrangement and in doing so elected to alter your arrival or departure flights in any way, Kappa Tour is unable to arrange airport transfers for you; you are then responsible for arranging your own transportation to the first accommodation at the beginning of tour and back to the airport at the end of tour. In order to qualify for an airport transfer at the beginning of tour, you must arrive from your domestic home gateway to your tour’s international gateway on the scheduled start date as published. To qualify for an airport transfer at the end of tour, you must depart back to your domestic gateway from your tour’s final gateway on the scheduled end date.
It is your responsibility to review the published itinerary and to make your own arrangements to arrive in time for the first scheduled hotel overnight and tour activities, and to depart following the scheduled end date. Please review the itinerary closely for when tour activities begin based on time zone differences and travel times to said destination from your domestic home gateway.
You must start and finish your trip at the same domestic gateway. For example, you may not fly out of Boston and return to New York.
Kappa Tour cannot arrange extended layover requests. For example, if you are flying from Paris to Los Angeles, you may not stop over in New York for two days.
If you book your tour fewer than 99 days prior to departure, you must submit your Special Travel Arrangement request at the time of enrollment.
It is your responsibility to review your Special Travel Arrangement for accuracy. You must submit any changes or additional requests prior to 99 days before departure. At 99 days prior to departure, all Special Travel Arrangement requests are considered final. After this point, changes to travel dates, destination cities, or any other adjustments are subject to penalties or fees determined by the airline; you are responsible for any such costs.

 

10.5. Tour information

While touring, please note that seats are on a first come first serve basis. We may, at our discretion, require any person to withdraw from any tour if we deem their acts or conduct offensive or a nuisance to other passengers, and we shall have no further liability. We reserve the right to cancel any tours due to lack of demand and also to use vehicles as dictated by demand. We also reserve the right to alter at any time any price, place visited, itinerary or hotel owing to unforeseen circumstances. Every endeavor will be made to advise passengers in advance of any alterations which are deemed necessary.
In the event of any passenger not being carried for any cause whatsoever, no liability will be accepted by the operators beyond the refund of the fares. Should the passenger fail to arrive or arrive late at the starting point or during the tour, then no liability whatsoever can be entertained.

 

· The tour route specified in the tour itinerary is an example route and there may be changes in the route.

· Kappa tour reserves the right to change the tour route when it deems necessary, provided that the content remains the same.

· City tours can be carried out the next day/days according to the arrival time in the city.

· Kappa tour reserves the right to change hotel names, provided that the star category remains the same.

· All hotel names mentioned in the programs *Or similar and is written as an example for star category and distance. It does not mean that you will stay in the hotel with the specified name.

· The minimum number of participants in this package tour is 40 people for each hotel category. If the number of people will not be enough, our customers will be notified 21 days before of the tour departure for the cancellation.

· Alternative tours on the way take place if at least 6 people from the group participate. Guests who do not want to participate will be waiting at the pit stop point.

· The excursions specified in the programs can be made on another day other than the specified day/days for any reason at the discretion of the guide.

· For excursions or tours that are not allowed by local authorities for any reason or alternative tours with participant of less than 20 people cannot be organized. Kappa Tour will not be responsible for these trips or tours not being done.

· Any Entrance fees for entrance in museums and archaeological sites are not included in the price.

· For the triple rooms there will be an extra added bed for the 3. person in the room. The third bed is smaller than the standard bed and / or it is an additional bed that can be portable bed.

· Child discount is only valid for children of certain age group staying together with 2 adults.

· The breakfast standard in hotels is Continental and consists of butter, jam, bread, coffee or tea. Group breakfasts are taken in separate lounges in hotels and are different from individual passenger breakfasts.

11. COMPLAINTS

If you experience a problem during your holiday, please immediately inform the relevant supplier so that they can take steps to put things right. You can also reach us using the “Contact Us” form on our website, or through our Emergency line that will be communicated to you before travelling.

If your complaint remains unresolved and you wish to complain further, please send formal written notice of your complaint to us within 28 days of the end of your arrangements, giving your booking reference and all other relevant information. Failure to follow the procedure set out in this clause may affect ours and the applicable supplier’s ability to investigate your complaint and could affect your rights under our agreement.

12. YOUR BEHAVIOUR

If in our opinion or in the opinion of any person in authority, your behavior is causing or is likely to cause distress, danger, damage or annoyance to any third party or property, or to cause a delay or diversion to transportation, we reserve the right to terminate your arrangements immediately. In the event of such termination our responsibilities to you will cease and you will be required to leave your accommodation or other service immediately. We will have no further obligations to you and will not meet any expenses, costs or losses incurred as a result. You may also be required to pay for loss and/or damage caused by your actions directly to the applicable supplier prior to departure from the service. If you fail to do so, you will be responsible for meeting any claims and costs subsequently made against us as a result.

13. OUR RESPONSIBILITIES

We accept responsibility as an organiser under the Package Travel, Package Holidays and Package Tours Regulations. Subject to these booking conditions, if we or our suppliers negligently perform or arrange the services which we are obliged to provide for you as set out on your confirmation, we will pay you reasonable compensation. Please note that it is your responsibility to show that we or our supplier(s) have been negligent if you wish to make a claim against us.

We will not be responsible or pay you compensation for any injury, illness, death, loss, damage, expense, cost, or other claim of any description if it results from:

  • The act(s) and/or omission(s) of the person(s) affected;
  • the act(s) and/or omission(s) of a third party unconnected with the provision of the services contracted for and which were unforeseeable or unavoidable; or
  • unusual or unforeseeable circumstances beyond ours or our supplier(s) control, the consequences of which could not have been avoided even if all due care had been exercised; or
  • an event which either ourselves or suppliers could not, even with all due care, have foreseen or forestalled.

We may however provide you with reasonable assistance in the event you experience difficulty arising out of these circumstances if your arrangements amount to a package.

We will not be responsible or pay you compensation:

  • For services or facilities which do not form part of our agreement or where they are not advertised by us. For example, any excursion you book while away, or any service or facility which your hotel or any other supplier agrees to provide for you;
  • for any damage, loss or expense or other sum(s) of any description which on the basis of the information given to us by you concerning your arrangements prior to them being confirmed, we could not have foreseen you would suffer or incur if we breached our contract with you; or that relate to any business;

Luggage and other personal belongings are transported at your own risk so should be supervised at all times. For air, rail, sea, or river transport the conditions set by transportation companies will apply, being the applicable passenger ticket document issued. In the event of harm, late delivery or loss, you shall report this immediately to the air carrier.

Any compensation that is payable will be calculated taking into consideration all relevant factors for example (but not limited to):

  • whether or not you have followed the complaints procedure as described in these conditions. It is a condition of our acceptance of liability under this clause that you notify any claim to ourselves and our supplier(s) strictly in accordance with the complaints procedure set out in these conditions;
  • the extent to which ours or our employees’ or suppliers’ negligence affected the overall enjoyment of your arrangements;
  • when making any payment, we are entitled to deduct any money which you have received or are entitled to receive from any transport provider or hotelier for the complaint or claim in question.

Please also note that where any payment is made, the person(s) receiving it (and their parent or guardian if under legal age) must also assign to us or our insurers any rights they may have to pursue any third party and must provide us and our insurers with all assistance we may reasonably require.

We shall be responsible to the client for supplying the services and accommodations described in the brochure of this website that is relevant to your booked trip, except where it cannot be supplied, or the itinerary is changed due to delays or other causes of whatever kind or nature beyond our direct control. In such circumstances, we and our suppliers will seek to offer comparable services, accommodations and itineraries and there shall be no refund in these circumstances.

Neither Kappa Tour, its suppliers, partners, agents and/or employees (“released parties”) shall be responsible or liable for cancellations, acts of other service providers, diversions or substitution of equipment or any act, variation, postponement, omission or default by air carriers, land carriers, hoteliers or hotels, transportation companies, or any other persons providing services or accommodations to guests including any results thereof, such as changes in services, accommodations or facilities. Nor shall we be liable for loss or damage to baggage or property, or for injury, illness, or death, or for any damages or claims whatsoever arising from loss, negligence or delay from the act, error, omission default or negligence of any person not its direct employee of them or under their exclusive control, including any act, error, omission, default, or negligence of any country, government or governmental authority, officer, or employee. The released parties shall not be liable for indirect, special, or consequential damages. All baggage and personal effects are at all times and in all circumstances at the risk of the guided vacation/holiday participant. Kappa Tour recommends that all persons on the booking obtain baggage insurance. Should the lost articles be found and returned to the owner, arrangements and related costs will be entirely the customer’s responsibility.

Generally, all operators, carriers, hotels, and other suppliers that provide services on holiday are independent contractors. They are not agents, employees or servants of Kappa Tour or its associated companies. All certificates and other travel documents for services issued by Kappa Tour are subject to the terms and conditions specified by the carriers and suppliers and to the laws of the countries in which the services are supplied. Carriage by sea is subject to the Carrier’s Conditions of Carriage which are expressly incorporated into this contract, copies of which are available upon request. The released parties are not responsible for any criminal or other conduct by third parties, whether criminal, intentional, grossly negligent, negligent, or otherwise.

Additional risks and dangers may arise including, but not limited to, hazards of traveling in undeveloped areas, hazards of travel by boat, train, automobile, aircraft and other means of conveyance, animal interactions, forces of nature, political unrest, other unrest, hazardous local customs and practices, differing levels of sanitation, differing standards of safety, risks associated with water, food, plants, insects and differing animal regulation, accident or illness in areas lacking means of rapid evacuation or medical facilities, and acts of national and local governments and unrest and acts of others against governments. These risks are not an exhaustive list but are examples of many kinds of risks. You are voluntarily participating in these activities with the knowledge that there are significant dangers involved, and you hereby agree to accept any and all risks. As lawful consideration for the agreement with Kappa Tour to participate in such trips and activities you agree you will not make a claim against Kappa Tour, its related companies or its personnel or sue for bodily injury, emotional trauma, death, property loss or damage or other loss, cost or expense, however caused, as a result of or related to your contracting for, traveling to or from, or in any and every other way participating in the trip. You release Kappa Tour, its related companies, and its personnel from any and all claims, known or unknown, arising from contracting for, traveling to or from, and in any and every way participating in a trip. This release of liability and assumption of risk agreement is entered into on behalf of you and all members of your family and party, also including minors accompanying you. This agreement also binds your heirs, legal representatives, and assigns.

14. JURISDICTION AND APPLICABLE LAW – CHOICE OF LAW

These Booking Conditions and any agreement to which they apply are governed in all respects by Delaware law . We both agree that any dispute, claim or other matter which arises between us out of or in connection with your contract or booking will be dealt with in a court of competent jurisdiction in the State of Delaware.

15. PASSPORT, VISA AND IMMIGRATION REQUIREMENTS AND HEALTH FORMALITIES

It is your responsibility to check and fulfil the passport, visa, health, and immigration requirements applicable to your itinerary. We can only provide general information about this. You must check requirements for your own specific circumstances with the relevant Embassies and/or Consulates and your own doctor as applicable. Requirements do change and you must check the up to date position in good time before departure. Most countries now require passports to be valid for at least 6 months after your return date. If your passport is in its final year, you should check with the Embassy of the country you are visiting. Up to date travel advice can be obtained from the Department of State, visit www.state.gov

We do not accept any responsibility if you cannot travel or incur any other loss because you have not complied with any passport, visa, immigration requirements or health formalities. You agree to reimburse us in relation to any fines or other losses which we incur as a result of your failure to comply with any passport, visa, immigration requirements or health formalities.

The airlines, in compliance with the requirements of the US Government, are legally obliged to allow the Bureau of Customs and Border Protection (CBP) US data to access certain travel and booking of passengers flying into / from or transiting through the US. This data is primarily used to prevent and combat terrorism, organized crime and other serious transnational criminal offenses.

Special note on COVID-19 situation

Should a PCR or any travel requirements necessary to enter the destination of a purchased trip, the arrangements within the required timescale and related costs will be entirely the customer’s responsibility. Once the trip has begun, should the client present any symptoms related to COVID, resulting in the modification of the contracted services, (e.g., night's stay, changes of hotel or flights) any additional expenses will be the customers responsibility and must subsequently be claimed from their insurance company.

16. FLIGHTS

The flight timings given on booking are for general guidance only and are subject to change. The actual flight times will be those shown on your etickets. You must accordingly check your etickets very carefully immediately on receipt to ensure you have the correct flight times. It is possible that flight times may be changed even after tickets have been issued.

We are not always in a position to confirm the airline, aircraft type and airport of destination which will be used in connection with any flight. When this information is provided at the time of booking or subsequently, it is subject to change. Any such change will not entitle you to cancel or change to other arrangements without paying our normal charges.

Our website is our responsibility and therefore it is not issued on behalf of, and does not commit the airlines mentioned herein or any airline whose services are used in the course of your travel arrangements.

Minors must travel with an adult and therefore Kappa Tour will not organize trips for minors unless they are accompanied by an adult.

General conditions of air transport

The airlines determine the conditions of implementation of air transport and are solely responsible for the changes in schedules or routes, stops, changes of airport delays and flight cancellations. In most cases, all these circumstances respond to the overbooking of airspace, the need to respect the rules of air navigation and the period of maintenance of aircraft at airports, all with the sole purpose of ensuring safety for passengers.

We will not be liable for any schedule changes, delays, cancellations, and other circumstances attributable to the carrier, your own actions or those of a third party or force majeure.

Please note that if you do not use the outbound flight ticket, the company can cancel the return flight.

Check-in and queuing times vary from airline to airline, and we recommend all travelers to arrive at the airport sufficiently in advance of the departure time. Procedures may vary, it is your responsibility to inform yourself about and fulfill the latest airline and entry requirements for your destination, return trip and any possible transit countries.

It is important to note that, once you have been issued with an eticket for your flight, that flight will not be refundable. To change requests, the conditions set by the airline for the appropriate fee will apply.

Airlines can make schedule changes or cancellations before departure, so it is your responsibility to confirm your flight within the 48 hours prior to departure:

In the booking process, we will request personal and contact information so that we may communicate, if necessary, any incident that may arise in your booking. We will have no liability if the data you provide is incorrect or incomplete.

Transportation companies, airlines etc. are not to be held responsible for any act, omission or event during the time guests are not on board planes, transportation or conveyances. We rely on international conventions which may apply to the services provided by us, our suppliers, or agents with respect to any claim of any nature brought by you against us as a result of the provision of those services. International conventions which apply may include: Warsaw Convention 1929, (as amended by Hague Protocol and Montreal Protocol) in relation to air travel, or Montreal Convention; the Berne Convention for rail travel; Athens Convention 1974 for carriage by sea; the Geneva Convention for carriage by road and the Paris Convention 1962 for Hotels. We are to be regarded as having all the benefits of these conventions on limiting our liability in relation to any claim for death, injury, loss, damage and delay to guests and luggage.

Documentation required for your trip.

The documentation required for your trip must include the name and surname of passengers as stated in its official documentation (ID card, passport or residence).

It is the responsibility of each passenger to ensure you have valid travel documentation which meets the requirements of the airline, immigration and the authorities of each destination, including transit and stop-over destination.

Please note that all passengers are required to carry a valid travel document (including infants and children).

- A Passport to travel outside the US must be valid for the period of intended stay. If a visa is applicable, any child / infant must travel with an adult figure in the photograph of the visa.

- All Citizens, who are not from the US, must have their travel documents validated and boarding pass before going through the airport security area.

- To Ensure compliance with all regulations, passengers should carry a valid passport (and visa if applicable) or a national identity card issued by a government of the US on all routes. The passenger will pay fines, penalties or costs arising out of breach of this requirement.

- The Green cards, driving license, family books, notepads maritime identification a police report (issued in case of loss or theft travel document), military identification cards, among others, are not accepted as valid documents. If the photo IDs expired or damaged, they will not be accepted on any flight.

- Data from travel documents of passengers (including children and infants) must be entered during the online check-in process. On all routes, passengers must present valid travel documents and online boarding passes at the airport security area and at the gate.

17. MISCELLANEOUS

Security is a major concern to all of us and the situation globally is constantly changing. Events around the world, coupled with the “Travel Advisories” put out by various governments, may at times necessitate changes to the accommodations and itinerary or even trip cancellation. You must accept these risks involved in travel to any country that may experience security difficulties and accept responsibility for your own travel decisions.

We recommend that all guests purchase comprehensive Travel Insurance. Certain countries have a requirement for foreign visitors to have valid medical insurance on entry. We cannot be held responsible for denied entry if a guest is unable to provide details to authorities of insurance or denial of entry for any reason.

In the case of computer or human billing errors, we reserve the right to re-invoice participants with correct billing.

Every effort is made to ensure brochure accuracy at the time of going to press; however, Kappa Tour cannot be held responsible for printing or typographical errors, or errors arising from unforeseen circumstances. Moreover, photographs and descriptions of locations or attractions are merely representative of conditions that existed at time of brochure printing and conditions may not be the same at the time of your journey.

All bookings made with any provider of any transport, facilities, meals, other goods or of any services are subject to terms and conditions and exclusions and/or limitations of liability imposed by them in relation to matters not covered particularly and expressly by our agreement.

If you decide that you do not want to visit a country or part of a country you intended to visit because of any law, condition or requirement of any government or governmental authority, official, servant or agent, you are responsible for any costs, expenses, charges, fees, losses, or damage incurred as a consequence and any cancellation or amendment fees. Neither Kappa Tour nor any of its staff or agents, accepts any responsibility or liability for your acts, omissions, defaults, conduct, state of health, condition, or circumstances.
